First Amendment, media and communications
As a subspecialty of the firm's constitutional law practice, Ellis & Winters attorneys have represented newspapers, radio stations, and television programming suppliers in cases involving First Amendment free speech and free press rights. Members of the firm have defended defamation claims, unfair trade practices claims, and assault claims, all related to the exercise of free speech. Our attorneys have advised media entities and others on the laws pertaining to public records requests, open meetings requirements, and various press privileges and rights, and also advise clients who are themselves subject to public records requests. On behalf of media interests, our attorneys have also prosecuted numerous claims for satellite signal piracy, including claims under the federal Cable Communications Policy Act, the Digital Millennium Copyright Act, the Wiretap Act, and the corresponding North Carolina statutes on behalf of media interests.
