Appellate Practice

Chambers USA conferred upon Ellis & Winters’s appellate practice a Tier 1 ranking, while Benchmark Litigation awarded the firm’s appellate practice a rating of “Highly Recommended.”

Seventeen of the firm’s litigators have clerkship experience.  Six Ellis & Winters lawyers clerked for appellate judges, including five for federal appellate judges.  The firm has clerkship experience on the Third, Fourth, Eighth, and Ninth Circuits.

The firm takes pride in its leadership within the national and state appellate bar.  Longtime Ellis & Winters partner Matt Sawchak was recently appointed as the Solicitor General of North Carolina.  Stephen Feldman is a chair of the American Bar Association’s Appellate Practice Committee.  Mr. Feldman and Kelly Dagger serve on the section council for the North Carolina Bar Association’s Appellate Practice Committee.  Paul Sun, Jon Sasser, and Mr. Feldman have all served as speakers at North Carolina’s annual appellate practice CLE program.  Ellis & Winters attorneys have also served as the chairs of the North Carolina Appellate Rules Committee — the committee that advises the North Carolina Supreme Court on rules of appellate procedure.

The firm’s lawyers have litigated well over one hundred appellate matters.  These matters involve not only trial court cases litigated by the firm’s attorneys, but also new appeals in which the firm did not participate in the trial court.  The firm’s appellate lawyers are also sought out to author amicus curiae briefs to aid the appellate courts in their deliberations.
