Jeff Warren Featured in George Mason University’s Civil Rights Law Journal
Jeff Warren’s article on the history of North Carolina’s “fruits of labor” clause was recently published in George Mason University’s Civil Rights Law Journal.
The article covers the clause from its Reconstruction-era origins to its revival in the North Carolina Supreme Court’s 2025 trilogy. Jeff argues that the decisions strengthened the constitutional right to earn a living, but left important questions unanswered. The article proposes a different framework for deciding when courts should defer to the State—and when they should take a harder look at government action that keeps people out of lawful work.
