Stephen Feldman Interviewed by North Carolina Lawyers Weekly on Major Antitrust Decision

Ellis & Winters LLP partner Stephen Feldman was recently interviewed by North Carolina Lawyers Weekly on his insights in antitrust and appellate law. The article, “Business Court Seeks High Court Guidance in Antitrust Case,” concerns a new decision by the North Carolina Business Court on whether consumers may sue a healthcare provider for violation of North Carolina’s antitrust laws and whether the Business Court’s decision is appealable to the North Carolina Supreme Court.

In the interview, Mr. Feldman described the role of pleading standards in antitrust cases. The meaningful factual allegations in the plaintiffs’ complaint, Mr. Feldman explained, fueled the Business Court’s decision to deny the providers’ motion to dismiss the case. Mr. Feldman also noted the rarity of the suggestion by the Business Court that the North Carolina Supreme Court accept discretionary review of the Business Court’s decision.
